Membership Terms and Conditions

Welcome to Volen HK (hereinafter referred to as "the Club," "we," or "Volen"). These terms apply to your use of the Volen HK mobile application (APP), website, physical clubhouse, and participation in any online or offline activities organized by the Club.

When you register, purchase, or use any of the Club's services (including but not limited to the Volen HK APP, website, physical clubhouse, or related activities), it indicates that you have carefully read, understood, and agree to be legally bound by these terms and the <Privacy Policy>. If you do not agree to these terms, please do not register, purchase, or use our services.

The Club will strictly comply with Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) when collecting, using, storing, and transmitting your personal data. For information on how we handle your data, please refer to the separate <Privacy Policy Statement>, which forms part of these terms.

Volen HK reserves the right to modify these terms at any time. The amended terms will be published on the Volen HK website and APP and will take effect from the date of publication. Your continued use of the services indicates your acceptance of the amended terms.

Definitions

In these terms, unless otherwise specified, the following terms have the following meanings:

Services: Refers to any online or physical services provided by Volen HK, including but not limited to APP features (such as events, chat, social networking, store, points rewards), website features, physical clubhouse activities, and related community interactions.
Member: Refers to a user who has registered and agreed to these terms.
P Card: Trial version membership, permanently free, to experience the community atmosphere.
Volen: Standard membership, with rights to online interactions and event participation, through In-App Purchase (IAP) or website subscription.
Volen+: Refers to advanced physical membership that has undergone real-name verification and paid the physical clubhouse management fee. This fee is fully used for the maintenance and management of physical facilities. The corresponding identifier in the APP is merely a digital mapping of the physical identity and does not include additional digital paid features.
Founding Membership: Co-creating members personally invited by the Volen HK president, with core decision-making rights at this level.
DORM Chat Room: Refers to the designated community chat room within the APP.
Physical Membership Card: Refers to the physical membership card issued by Volen HK, used to verify physical membership identity.
Renewal Date: Refers to the specific date for membership renewal.
IAP: Refers to payments made through In-App Purchase via the Apple App Store or Google Play.
Stripe: Refers to the payment gateway used by the Volen HK website.

Membership Eligibility and Registration

Eligibility: You must be at least 18 years old, have the capacity to enter into legally binding contracts, and be a Hong Kong resident or working youth to register as a member. Volen HK reserves the right to reject any registration application from ineligible individuals.
Registration: During registration, you must provide true, accurate, and complete personal information, including but not limited to name, email, phone number, and identity verification details. Upon completion of registration, you will default to P Card membership. You agree that Volen HK may verify your information and require additional proof if necessary.
Account Security: You are responsible for maintaining the security of your account password and for all activities under your account. If you discover unauthorized use, you must immediately notify Volen HK. Volen HK is not responsible for losses due to account security issues.
Agreement to Terms: Before registering, purchasing, or using services, you must explicitly agree to these terms. Those who do not agree may not use the services.

Prohibited Member Conduct

If a member engages in any of the following prohibited behaviors while using the Club's services, the Club reserves the right to suspend the account or terminate the account's services without warning and without refund. For illegal activities, we will report to law enforcement or cooperate with investigations.
Do not engage in any illegal activities or post illegal content.
Do not engage in any form of multi-level marketing, direct sales, insurance solicitation, financial investment promotion, Crypto/Web3 promotion, or beauty treatment sales.
Do not post any harmful content:
- Multi-level marketing, direct sales, pornography, illegal, racism, threats, defamation, reactionary, gambling, slander, fraud, content violating public policy, infringing third-party intellectual property rights or other rights, or otherwise illegal content
- Content containing hate speech, "spam," malicious code, adware, spyware, or malicious download applications
- Promoting pornography, use of illegal substances, illegal activities, racism, hate, "chain letters"
Do not bully or harass others, including but not limited to any form of sexual harassment or disturbance through text, voice, images, or physical contact.
Do not infringe on others' privacy rights. Sharing photos of others in private spaces (such as bathrooms, bedrooms, changing rooms, or medical facilities) without their knowledge and consent is prohibited; sharing others' private information without their knowledge and consent, or for harassment purposes (i.e., "doxxing"), is also prohibited.
Do not infringe or violate others' rights, including their intellectual property rights (e.g., infringing others' copyrights or trademarks, or distributing or selling counterfeit or pirated goods), unless exceptions or limitations apply under applicable law.
Do not use the Club's services in illegal, misleading, discriminatory, or fraudulent ways, or assist others in doing so.
Do not upload viruses or malicious code, do not use the services to send spam, or engage in any other activities that may cause our services, systems, or products to malfunction, compromise integrity, operation, or appearance, overload, interfere with, or damage their normal operation, integrity, or appearance.
Do not use automated means to access or collect the Club's data, nor attempt to access data you are not authorized to access.
Do not act as a proxy, request, or collect usernames or passwords of the Club's users, or misappropriate access tokens.
Do not sell, license, or purchase any data obtained from us or our services.
Do not abuse any reporting, flagging, dispute, or appeal channels, such as submitting fraudulent, repetitive, or baseless reports or appeals.
Do not edit, alter, modify, adapt, translate, or otherwise change all or any part of the software, nor allow all or any part of the software to be combined or incorporated into any other software, nor decompile, disassemble, or reverse engineer the software, or attempt any such operations.
Do not copy, duplicate, distribute, resell, or otherwise use the software for any commercial purposes.
Do not allow any third party to use the software on behalf or for the benefit of any third party.
Do not use the software in any manner that violates any applicable local, national, or international laws.
Do not use the Club's software for any purposes that the Club deems to violate this license agreement.

Warning and Disciplinary Mechanism

The Club adopts a two-yellow-one-red mechanism similar to soccer to issue warnings and penalties to violators. The Club determines whether to issue a yellow card as a warning or a red card for immediate membership cancellation based on the severity of the violation. When a member receives a second yellow card, it is equivalent to receiving a red card. Below are the detailed definitions and explanations of yellow and red cards by the Club:

Yellow Card
- A yellow card is issued to a member as a warning for non-serious violations.
- Yellow cards have an expiration date; upon issuance, an expiration date is attached, and they are automatically destroyed after expiration.
- The duration is determined by severity, ranging from 1 to 12 months.
- The yellow card will be displayed next to the member's name and in the member profile, but the reason for issuance and violation details will not be shown.
Red Card
- A red card is issued to a member for serious violations to cancel membership; or when a member receives a second yellow card, the system automatically destroys the two yellow cards and issues a red card to cancel membership.
- Red cards are permanent and once issued, cannot be revoked.
- The red card will be displayed next to the member's name and in the member profile, but the reason for issuance and violation details will not be shown.
- If a member is issued a red card (terminating membership) by the Club for violating the "Prohibited Conduct" in these terms or accumulating two yellow cards, the Club will consider it a fundamental breach. In this case, the Club has the right to immediately terminate your account and all service usage rights, and will not refund any remaining membership fees. This no-refund arrangement is to compensate for the administrative costs, goodwill loss, and system maintenance expenses incurred by the Club in handling your violation. You agree that this arrangement is a reasonable liquidated damages provision. In case of dispute, the Club's system records and final decision shall prevail.
- For illegal activities, we will report to law enforcement or cooperate with investigations.
- If a member disagrees with the penalty, they may submit a written appeal to the Club within 7 days of receiving the notice. The Club will review it, and the review result is final.
